Frequently Asked Questions

Can foreign investors hold 100%?
In some sectors, yes. Pesticide-related business touches the restricted list under the Foreign Business Act, so pure trading usually requires Thai majority ownership or a BOI exemption. The right structure depends on your scope of business, and we set out the workable options at assessment.
How long does incorporation take?
With complete documents it usually takes one to two months to the business licence, tax registration included. Applying for BOI privileges adds several more months.
Is there a minimum capital requirement?
Yes. A wholly foreign-owned company is generally required to have at least 2 million baht, and where work permits for foreign staff are involved there are higher capital and employment-ratio requirements. The exact figure depends on the structure and your hiring plan.
Do shareholders need to come to Thailand in person?
Usually not. It can be done through a power of attorney with notarised and legalised documents, filed by us on your behalf. A few banks require directors to sign in person for account opening, which we arrange in advance.
